Use of our Content and Materials

A. Our Intellectual Property

On this website, and in other mediums controlled by us, House of Epula™ uses intellectual property (“IP”) that it owns, or licenses, or that is otherwise subject to proprietary rights.  We provide notices, as appropriate, to identify IP owned by third parties that we use under license or with permission from the owner.  

For greater certainty, the IP used by us includes, without limitation:  works subject to copyright, including written descriptions, stories and other original texts, artwork, designs, graphics, photographs, sound files, video files, and our selection, compilation and arrangement thereof; trademarks, design marks and service marks, including House of Epula™, the trademarks of our partners, and distinctive names for our Spices and other Native plant offerings; trade dress, including packaging designs and the look and feel of our website, including all page headers, custom graphics, button icons and script fonts; and trade names, including “House of Epula Boutique Inc.”  Some of our IP is subject to more than one proprietary right, such as our design marks which may comprise both copyright and trademark rights.

Our IP is protected by Canadian and international laws, including laws relating to intellectual property rights and laws against unfair competition and misappropriation or misrepresentation.

B. Scope of use

House of Epula grants you permission to access and use our website and to display and print its content, including our IP, only for your personal use and non-commercial use, provided you do not modify the accessed materials and that you retain all associated copyright, trademark, and other proprietary notices.

For greater certainty, your own “personal use” does not include re-posting, distributing, or other public use of any content in whole or in part on personal social media or other platforms that can be seen or heard by others, even if it is your own personal social media account.

You may not copy, distribute, reproduce or publish, in whole or part, any content. We also prohibit the use of any of our IP to create derivative works of any of our content in whole or in part.  For greater certainty, use of any of the IP available on this website for commercial purposes including for resale and redistribution, is strictly prohibited, except with our prior express written authorization.

We reserve all rights against anyone who uses our IP contrary to these Terms of Use. 

C. Concerns and questions

House of Epula holds the highest regard for the intellectual property rights of others and we ask you to do the same. Please reach out to us us at [email protected] if: 

• You perceive that our website comprises any unauthorized third-party IP, including yours. Please identify the subject matter of concern, together with the name and contact information for the owner of such third-party IP, and, if different, your name and contact information so we can respond to your concerns. 
• You seek our permission to use any of our IP for purposes other than personal use.  Please provide us with the details of how you would like to use our IP so that we may consider your request.

D. Infringer policy

House of Epula may, at its sole discretion, limit access to our website and/or terminate the use of any guest who infringes our IP and the intellectual property rights of others (regardless of whether there is any repeat infringement).
